The petitioner apprehends his arrest in a case registered for the offence under Sections 363, 366(A) of the Indian Penal Code and Section 12 of the POCSO Act. It is submitted on behalf of petitioner that during investigation, the victim girl was recovered and she has clearly stated that nobody has kidnapped her and she has solemnized marriage with this petitioner out of her own sweat will. Victim is major and both of them are living as husband and wife in Punjab. It is next submitted that F.I.R. has been lodged after a delay of 18 days without any plausible explanation of delay. Petitioner has got clean antecedent.
Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
