This is an application for grant of anticipatory bail in connection with Shambhuganj P.S. Case No. 185 of 2019, registered for the offence punishable under Sections 448, 341, 323, 354(B) and 504/34 of the Indian Penal Code. The allegation is regarding the co-accused persons having arrived at the house of the informant and thereafter, they are stated to have abused the informant and his family members. As far as the petitioners are concerned, they are stated to have torn the blouse of the informant.
The learned counsel for the petitioners submits that the

No.8985 of 2020(2) dt.03-03-2020 2/2 petitioners are innocent, ornamental allegations have been levelled in order to make the allegations grave in nature and in fact, no such incident, as alleged, had ever taken place. It is further submitted that there is no report on record to indicate that the prosecution party had received any injury. The petitioners are stated to be having a clean antecedent. Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioners, I deem it fit and proper to admit the petitioners to the privilege of anticipatory bail.
Accordingly, the petitioners are directed to be enlarged on anticipatory bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Banka in connection with Shambhuganj P.S. Case No. 185 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
