1. Heard learned Counsel for the parties concerned.

2. Learned Counsel for the petitioner submits that a counter affidavit has been filed by respondent no. 8-Nagar Panchayat, Bennipatti, Madhubani, in which it has been stated that the petitioner has been given compassionate appointment and he has joined the post of Peon also.

3. In view of the aforesaid, learned Counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. This application is dismissed as withdrawn.

6. Insofar as payment of salary of the petitioner is concerned, the petitioner is given liberty to file representation before the appropriate authority.

7. If such a representation is filed, the authority concerned is obliged to consider the claim of the petitioner in accordance with law within a period of five weeks from the date of filing of the representation.
