Petitioner apprehends his arrest in a case registered under Sections 147, 148, 149, 341, 302 of the Indian Penal Code and 27 Arms Act.

Informant has alleged in his written complaint that on 01.09.2019 at about 4.30 PM his son and his villager Lallan Yadav had gone to Market. In the meantime, Bijendra Yadav gave order to Ramesh Yadav to kill both of them. Guddu Yadav and Pappu Yadav surrounded them, thereafter Dinesh Yadav and Uday Yadav caught hold the hands of his son and Ramesh Yadav, Baiju Yadav, Guddu Yadav, Prabeen Yadav and Jai Chandra Yadav shot his son and Raushan Yadav, Mahadev

Patna High Court CR. MISC. No.7772 of 2020(2) dt.28-02-2020 2/2 Yadav, Fantush Yadav (petitioner) shot Lallan Yadav, as a result of which his son and Lallan Yadav died. It is alleged that the informant and Naresh Yadav, Mithilesh Yadav, Rajo Yadav, Manoj Yadav Hire Devi,and Kajal Devi had witnessed the occurrence.

There is direct allegation against petitioner that he shot Lallan Yadav, as a result of which he died. Considering the nature of allegation against petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly this application is dismissed. (S. Kumar, J) veena/- U T
