The petitioner seeks bail in a case registered for the offence punishable under Sections 302 IPC and 27 of the Arms Act.
It is submitted that FIR has been lodged against unknown. During investigation, the name of the petitioner has appeared in the confessional statement of Simali Devi, wife of the deceased. Nothing has been recovered from the possession of the petitioner. Only suspicion has been raised against him. Learned counsel for the State submits that apart from the confessional statement of the wife of the deceased there is also evidence to show that the petitioner along with co-accused has
Patna High Court Cr.Misc. No.47751 of 2014 (3) dt.20-03-2015 2/2 committed the offence. After investigation charge-sheet has been submitted against the petitioner. The deceased was last seen with the petitioner and Ajit Kumar.
Considering the facts and circumstances, in my opinion, the petitioner does not deserve bail at this stage. His prayer for bail is rejected.
Let the trial be expedited.
