====================================================== CORAM: HONOURABLE MR. JUSTICE AJAY KUMAR TRIPATHI and HONOURABLE JUSTICE SMT. NILU AGRAWAL ORAL ORDER (Per: HONOURABLE MR. JUSTICE AJAY KUMAR TRIPATHI) 23-01-2018 Heard counsel for the appellant. Perused the impugned order dated 28.07.2016.
The reasons for dismissal of the writ application are two fold, one that an order dated 31.08.1994 passed in Consolidation Revision Case No.2044 of 1986 is sought to be challenged by
Patna High Court LPA No.1747 of 2016(4) dt.23-01-2018 2/2 one of the sons after more than ten years and second that not all the sons have grievance against the decision nor did the father. In view of the same, settled position cannot be unsettled at the asking of the litigant at such belated time. Appeal has no merit. It is dismissed.
