The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 394 of the Indian Penal Code and Section 25(1-b)a of Arms Act.
The prosecution case in nutshell is that while the informant was sleeping in her house, two persons entered the house of informant and pressed her mouth and started assaulting. It is further alleged that they snatched her silver chain and gold ear ring. They demanded money and key of box on the point of
Patna High Court CR. MISC. No.9892 of 2023(2) dt.06-04-2023 2/3 weapon. On objection, she was assaulted due to which she sustained injuries. It is further alleged that on hulla, villagers came and one of the miscreants was caught, who identified as petitioner.
It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. It is further submitted that petitioner and informant are next door neighbors and due to prior dispute the name of petitioner has falsely been dragged in this case. It is further submitted that no theft article has been recovered from the possession of the petitioner. Moreover, the petitioner is languishing in judicial custody since 13.08.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Learned APP appearing for the State has vehemently opposed the prayer for Bail.
Having heard learned counsel for the parties and taking into consideration the facts and

The above named petitioner is directed to be enlarged on bail in connection with Habibpur P.S. Case No. 131 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.F.C., Bhagalpur.
