The petitioner has filed this writ petition seeking a writ in the nature of mandamus cancelling the auction process pursuant to notice dated 13.02.2020, the same being vitiated. The stand of the State is that auction has been conducted strictly as per law. Referring to paragraph nos. 9 and 10 of the counter affidavit,

Patna High Court CWJC No.5954 of 2021 dt.03-02-2022 2/2 learned counsel for the petitioner submits that the shop would definitely be allotted to the highest bidder. On a query being put to learned counsel for the respondents about the refund of earnest money of the rest of the bidders, he fairly submits that the same shall be refunded at the earliest in any case not later than four weeks. The petitioner is satisfied with the aforesaid statement.

Under the circumstances, no further adjudication of the matter is necessary.
