The petitioner seeks bail in a case registered for offences punishable under Sections 302/34 of the Indian Penal Code.
It is submitted that allegation in the first information report is that 7 persons had participated in killing of the deceased by severing his head from the neck but, in the further statement, the informant has stated that this petitioner along with Suresh Prasad had severed the head of the deceased from the neck, whereas, two persons, namely, Navin Prasad and Devendra Prasad were
Patna High Court Cr.Misc. No.47949 of 2014 (2) dt.21-01-2015 2 / 2 standing there. Two of them have been granted bail. However, in view of direct and specific allegation by the informant in his further statement upon the petitioner regarding killing of the deceased, this Court is not inclined to grant bail to the petitioner at this stage.
