The petitioner seeks bail in a case registered for offences punishable under Sections 363, 366(A), 120B and 34 of the Indian Penal Code.
It is submitted on behalf of the petitioner that the girl was recovered on the next date of the alleged kidnapping and had stated in her statement recorded under Section 164 of Cr.P.C. that there was love affair between her and the petitioner and she had accompanied him at her own will as her father wanted that she should be married with some body else. It has further been stated that she has already married the petitioner in a temple and after
Patna High Court Cr.Misc. No.48640 of 2014 (2) dt.03-03-2015 2/2 marriage she had gone to her in-laws house and not with her parents which appears from Annexure 5 which is the release order dated 13.8.2014. The court below has assessed the age of the girl to be between 17 to 18 years.
Having considering the facts and circumstances of the case, the petitioner, namely, Akshay Kumar Ray is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sri M. Alam, Judicial Magistrate, 1st Class, Katihar in Abadpur P.S. Case No. 87/2014.
