The petitioner is an accused in connection with Chand P.S. Case No. 42 of 2015 registered under Sections 304(B)/34 of the Indian Penal Code pending in the court of Chief Judicial Magistrate, Bhabua.
Accusation is of putting on fire to Laxmina Devi, daughter of the informant, by her husband and in-laws, who died due to burn injury. While informant was present at the door and he received information to his daughter.
Learned counsel for the petitioner submits that deceased wanted to go to her Maika but the informant was not ready to take her due to that reason she committed suicide by burn,
Patna High Court Cr.Misc. No.50807 of 2015 (3) dt.04-02-2016 while the informant was present at the door.
Taking into consideration the facts and circumstances of the case and the nature of allegation, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected.
