Petitioner apprehends arrest in a case registered for the offence punishable under sections 341, 506, 354 and 509/34 of the Indian Penal Code and under Section 8/12 of POCSO Act. It is alleged that the petitioner tried to outrage the modesty of the informant.
Learned counsel for the petitioner submits that both the parties are neighbours. There is case and counter case between the parties. It is further submitted that the informant herself wanted to marry the petitioner and she also used to send mobile messages to him. Therefore, no case of molestation is

Learned counsel for the State opposes the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Session Judge, VI cum Special Judge (POCSO), Madhubani in connection with Babubarhi P.S. case no 188 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
