The petitioners seek bail in a case registered under Sections-18, 20 & 22 of NDPS Act.

The prosecution case, in short, is that 500 gms opium is recovered.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 10-10-2018. Charge sheet in this case has already been submitted. 500 gms opium is recovered. Same is below the commercial quantity.

Patna High Court CR. MISC. No.9110 of 2019(4) dt.17-04-2019 2/2 There is no compliance of Section 100 Cr.P.C. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge (NDPS) Act, Gaya in connection with NDPS Case No. 37 of 2018(CIS) arising out of Barachatti P.S. Case No. 666 of 2018.
