JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-06-2020 Heard learned counsel for the petitioners and learned learned Additional Public Prosecutor for the State. The petitioners are apprehending arrest in connection with Buxar (Muffasil) P.S. Case No. 380 of 2018, Ex. G.R. 965 of 2018 for the offenses under Sections 272, 273 IPC and 30(A) of the Bihar Prohibition and Excise (Amendment) Act, 2018. Learned counsel for the petitioners submits that petitioners have no criminal antecedent. Nothing was recovered from the possession of the petitioner. The recovery was made from bundle of paddy crops in the Khalihan. The petitioners have been made accused due to enmity.

Considering the fact that recovery was made from

No.9560 of 2020(2) dt.10-06-2020 2/2 Khalihan, an open place and the petitioners have no criminal antecedent, the Court is inclined to grant anticipatory bail to the petitioners. Let the petitioners, above named, in the event of arrest or surrender before the court below within a period of four weeks, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum- Special Judge (Excise), Buxar in connection with Buxar Muffasil P.S. Case No. 380 of 2018, Ex. G.R. No. 965 of 2018 subject to the condition that on release the petitioners shall render their services as volunteers to combat the pandemic of Covid-19 for a period of one month. They are required to report to the Civil Surgeon/ Nodal Officer, Covid-19, Buxar, who shall utilize their services appropriately.
