09-12-2015 Heard Sri Nityanand Mishra, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner, who is in custody since 10-11-2014 in Special Case No. 19 of 2014 (arising out of Mirganj P.S. Case No. 110 of 2014) registered for the offence under Sections 420/120(B) of the Indian Penal Code and Section 20/20(B)II, C/22/23/29 of the Narcotic Drugs & Psychotropic Substances Act, 1985, has prayed for grant of bail.
Learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner, only it was alleged that the petitioner was in a Bolero, from which 45 kg. Ganja was recovered.
In the occurrence, 900 kg Ganja was recovered from a
Patna High Court Cr.Misc. No.52601 of 2015 (2) dt.09-12-2015 2/2 truck and 45 kg Ganja was recovered from the vehicle Bolero. In view of recovery of huge quantity of Ganja, I do not find any ground to extend the privilege of bail. The petition stands dismissed.
Since the petitioner is in custody, while dismissing the present petition, it is desirable to observe that learned court below may take appropriate step so that the case may come to its logical end without unnecessary delay.
