ANSARI ORAL ORDER 11-02-2015 This is an application, made under Section 439 of the Code of Criminal Procedure, seeking bail for the accusedpetitioner, namely, Ravi Sharma, in connection with Sikta Police Station Case No. 69 of 2014, under Sections 20, 22, 23, 24, 27(A) and 29 of the Narcotic Drug and Psychotropic Substance Act.
Perused the above application and materials on record.
Heard Mr. Mukesh Kumar, learned counsel for the petitioner, and Mrs. Asha Devi, learned Addl. Public Prosecutor, appearing on behalf of the State. Considering the nature of incriminating materials available against the accused above-named, this Court is of the view that the accused above-named cannot, at this stage, be allowed to go on bail inasmuch as the two accused
Patna High Court Cr.Misc. No.48350 of 2014 (2) dt.11-02-2015 2/2 persons are, according to materials collected during investigation, tried to flee away together, when they were asked by police personnel to stop on the Indo-Nepal border. In view of the above and in the interest of justice, the prayer for bail is hereby rejected at this stage. This Bail application shall stand disposed of accordingly.
