The petitioner is apprehending his arrest in a case registered under Sections 307, 341, 323 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case, in short, is that while the father of the informant was working at his field, the accused persons variously armed came and fired due to which he sustained injury.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. From the order of the Sessions Court, it is apparent that the nature of injury has not been indicated in the injury

Patna High Court Cr.Misc. No.8855 of 2019(2) dt.19-02-2019 2/2 report. There is a case and counter case between the parties. The counter case is Annexure-2 to the present application. The counter case was instituted for offence under Section 302 IPC as the father of the petitioner was murdered by the prosecution side.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R./complaint case. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Mohania P.S. Case No. 608 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) Pankaj/- U T
