The petitioner seeks bail in Madhiuban P.S. Case No. 12 of 2002 (Trial No.4812 of 2014) instituted under sections 498A and 302/34 IPC. The FIR lodged by the mother of the deceased depicts the manner in which the deceased was married to the son of the petitioner who later died and subsequently on the pressure of the society she was married to the younger brother of her husband. Torture was perpetrated on her thereafter by the family members. On the relevant day i.e. on 01.02.2002 she was done to death by setting her on fire inside the matrimonial home. Counsel for the petitioner submits that her husband has already been released on bail in 2004. The petitioner is in custody since 12.07.2014.

Learned APP has pointed out that charge sheet was ultimately submitted in the year 2009 showing her absconder. Considering the aforesaid facts, this Court, for the present, is not inclined to release the petitioner on bail. Her prayer for bail is rejected.

The petitioner is granted liberty move this Court if the trial in the meanwhile does not record adequate progress within six months from the date of receipt/production of a copy of this order in the court below.
