JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-02-2020 Heard learned counsel for the petitioner and the State. The petitioner is apprehending arrest in connection with Nawada P.S. Case No. 1486 of 2019 for the offence under Sections 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
In the instant case 53 litres liquor was seized from the lane and not from the conscious possession of the petitioner. Considering the fact that the petitioner has no criminal antecedent and nothing was recovered from the conscious possession of the petitioner, the Court is inclined to grant bail to the petitioner, in the event of arrest or surrender within four weeks from today, on furnishing bail bonds of Rs.50,000/- (Rupees Fifty thousand) with two sureties of the like amount
