Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-05-2022 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioners seek bail in anticipation of their arrest in connection with Naurangiya P.S. Case No. 16/2020 instituted for the offences under Sections 406, 409 and 420/34 of the Indian Penal Code.

By order dated 04.01.2022, a Co-ordinate Bench of this Court had called for a report from the District Magistrate, West Champaran at Bettiah regarding the completion details of the work entrusted to the petitioners. The report which has been brought on record indicates that out of total amount of Rs. 23,34,600/- given to the petitioners, work has been done to the

Patna High Court CR. MISC. No.19306 of 2021(5) dt.13-05-2022 2/2 extent of Rs. 22,34,403/-.

It has been submitted on behalf of the petitioners that about a week ago, they had deposited Rs. 50,000/- and are also ready to return the balance amount of Rs. 50,000/- in the treasury.

Considering the afore-noted facts, the petitioners, above named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bagaha, West Champaran, in connection with Naurangiya P.S. Case No. 16/2020, subject to the condition laid down under Section 438

(2) of the Code of Criminal Procedure.
