Mr. Magan Kumar, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-04-2025 Heard learned counsel for the petitioners, the State and the informant.

2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code.

3. As per the prosecution case, when the informant was going to his site from the house, petitioner Anil Kumar and co-accused Vivek Kumar assaulted him with spade. Other accused persons assaulted him with axe, while petitioner no. 2 Sarveshwar Sah took out Rs.1.25 lacs and gold chain from the informant.

4. It is submitted on behalf of the petitioners that parties are next door neighboures and over a petty dispute, simple marpit took place between them in which both sides

Patna High Court CR. MISC. No.17634 of 2025(2) dt.09-04-2025 2/2 sustained injuries. Doctor has found simple injury. Rest of the allegations are ornamental. Petitioners claim clean antecedent.

5. Learned counsel for the State as well as the informant oppose the prayer for bail.

6. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within eight weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Sessions Judge III, Sahrasa in Saharsa Police Station Case No. 813 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
