JUSTICE JYOTI SARAN ORAL ORDER 25-01-2017 Heard Mr. Dineshwar Prasad Singh, learned counsel appearing for the petitioner(s) in the two applications, Mr. Asif Kalim, AC to AAG-12 for the State in MJC No.4325 of 2016 and Mr. Arun Kumar Bhagat, learned AC to AAG-12 for the State in MJC No.4326 of 2016.
These two applications have been filed praying for
Patna High Court MJC No.4325 of 2016 (2) dt.25-01-2017 modification of the judgment and order dated 7.8.2015 passed in CWJC No.1711 of 2014 and analogous cases in so far as the direction at paragraph 1 at page 6 of the judgment and order is concerned whereby the petitioners have been directed to appear before the SubDivisional Officer, Nalanda for disposal of the grievance in accordance with law.
It is submitted by Mr. Singh that the subdivision concerned in the present set of cases would be Hilsa Sub-division and since such sub-division has not been specified hence these applications for modification.
Having heard learned counsel for the parties and considering the submissions advanced, let the station of the SubDivisional Officer, mentioned at paragraph 1 at page 6 of the judgment and order dated 7.8.2015 be modified to read as 'SubDivisional Officer, Hilsa, District- Nalanda' in place of 'SubDivisional Officer, Nalanda' as it records in the judgment and order dated 7.8.2015 and which shall be deemed to have been pronounced as such.
The two modification applications are accordingly allowed. The judgment and order dated 7.8.2015 passed in CWJC No.1711 of 2014 and analogous cases stands modified to the aforementioned extent.
