2. The present writ petition has been filed for appointing the petitioner on the post of Anganbari Sevika in Ward No.3 under village Chintamanipur in the Panchayat of Chintamanipur.

3. Counsel for the petitioner submits that the petitioner has challenged the post of Anganbari sevika in Ward No.3 under village Chintamanipur in the Panchayat of Chintamanipur, District- Vaishali.

4. Counsel submits that he has filed representation before D.P.O. and District Magistrate, but nothing has been done.

5. Counsel for the State raised objection that the petitioner ought to challenge the same under the Rule before the DPO-I then before District Magistrate and then come to Hon'ble High Court.

6. In this view of the matter, this writ application stands disposed off, directing the petitioner to file a case under the relevant rule before the DPO and the DPO is directed to pass appropriate order on the application filed by the petitioner within 90 days after the date of appearance. Since general election of Lok Sabha, 2024 has been notified, therefore, 90 days shall be counted after end of the election.

7. With the aforesaid direction, the present writ application is hereby disposed off.
