JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-04-2023 The present writ petition has been filed seeking the following relief:- "1. That this writ application is being filed for issuance of writ in the nature of certiorari for quashing the order dt.
05.02.2016 passed by Anchaladhikari, Chakia in Misc. Case No. 04/2015-16, by which directed to concerning employee of the Anchal to submit report and thereafter, initiated the encroachment case in the light of the order dt.
Patna High Court CWJC No.13664 of 2016(2) dt.05-04-2023 2/3 12.01.2007 passed in Misc. Case No.
08/2005-06, aforesaid order has been passed in pursuance of the order dt.
04.01.2013 passed in CWJC No. 113/2013, again said very order petitioner had already been preferred appeal bearing LPA No. 390/ 2016 which is still pending for due consideration and further quashing order dt. 12.01.2007 passed by C.O., Chakia in Misc. Case No. 08 /200506 by which rejected the case of petitioners for settlement of land reasons behind, petitioners are not land less persons and further issued direction to the respondents consider the case of the petitioner for settlement in the name of the petitioners on the ground, they are residing since ago after construction of the Pucca house in the disputed land which is clear from the report dt.
13.12.1995 of the Anchaladhikari in Settlement Case No. 01/ 1995-96 and they are privileged person and further give other legal consequential benefit to the petitioners."
At the outset, the learned counsel for the petitioners seeks not to press the present writ petition, but seeks liberty to approach the
Patna High Court CWJC No.13664 of 2016(2) dt.05-04-2023 3/3 respondent authorities.
Accordingly, the present writ petition stands dismissed as not pressed, however, with the aforesaid liberty.
