2. The petitioner seeks bail in Nawada (Nagar) P.S. Case No. 680 of 2021, instituted for the offences punishable under Sections 33, 34 and 36 of the Bihar Prohibition and Excise Act.
3. The prosecution case, in short, is that, a U.D. case was registered and during investigation, it was found that father of the informant died due to consumption of adulterated wine and later on F.I.R has been registered.
4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. No
Patna High Court CR. MISC. No.12267 of 2024(2) dt.27-02-2024 2/3 incriminating material has been recovered from the conscious possession of the petitioner. Charge-sheet has been submitted in this case. The name of the petitioner transpired in this case on the basis of confessional statement of co-accused person. The petitioner is in custody since 19.01.2023 and has got eighteen criminal antecedents. Learned counsel for the petitioner further submits that similarly situated co-accused have been granted bail by Co-ordinate Benches of this Court vide order dated 01.11.2023 passed in Cr. Misc. No. 45389 of 2023, Cr. Misc. No. 53349 of 2023, Cr. Misc. No.59678 of 2023, order dated 04.08.2023 passed in Cr. Misc. No. 47507 of 2023, order dated 11.08.2023 passed in Cr. Misc. No. 49154 of 2023, Cr. Misc. No. 50091 of 2023, order dated 30.10.2023 passed in Cr. Misc. No. 52824 of 2023 and order dated 13.12.2023 passed in Cr. Misc. No. 61783 of 2023.
5. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case and the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.
7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two
