The petitioner seeks bail in a case registered under Sections 363, 366A, 376/34 of the Indian Penal Code and Section-4 of the POCSO Act.

The prosecution case in brief is that the informant's daughter was kidnapped by the accused persons. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 30-07-2018. Charge sheet has already been submitted. There was love affairs between the victim and the petitioner. The victim had left home with her

Patna High Court CR. MISC. No.9439 of 2019(3) dt.15-04-2019 2/2 own sweet will. The present case has been instituted against the petitioner due to family dispute. No abduction whatsoever was made. While the victim was travelling with the petitioner, at no point of time, she made any protest. The conduct of the victim appears to be doubtful.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-cum-Special Judge (POCSO), Patna in connection with Didarganj P.S.
