JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-02-2019 This is an application for grant of anticipatory bail in connection with Ramnagar (Bagha) P.S. Case No. 39 of 2018, disclosing offences under Sections 498A/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. Allegation against the petitioner is subjecting his wife to cruelty and harassment.

Submission of learned counsel for the petitioner is that the petitioner still ready to keep his wife with full dignity and care.

Heard learned A.P.P. as well as learned counsel for the informant, they have submitted that the opposite party no.2 is also ready to live with his husband.

No.10906 of 2019(2) dt.22-02-2019 2/2 Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with a direction to the petitioner to surrender before the court below on 07.03.2019 and on that date the opposite party no.2 shall also present before the court below and if the petitioner file an application that he is ready to keep his wife and on filing such application, the petitioner shall be released on provisional bail for a period of six months by the court below to his own satisfaction with the condition that the petitioner shall keep the opposite party no.2 with care and dignity and the learned court below by calling them on each month and if the court below is satisfied with their conduct, he shall confirm the bail bonds of the petitioner, otherwise he is free to pass any order or orders as he deems fit and proper.
