This application for anticipatory bail arises out of Arer P.S. Case No.44 of 2022 registered for the offence punishable under sections 272, 273 of the Indian Penal Code and under section 30(a) of the Bihar Prohibition and Excise Act.

It is alleged that about 300 ml. of illicit liquor has been recovered from a motorcycle, which was driven the by the son of the petitioner. The petitioner is the owner of the motorcycle. He has clean antecedent.

Considering the fact that the petitioner is the owner of the motorcycle from which 300 ml. of illicit liquor has been recovered and he has clean antecedent, this bail application is allowed.

Let the petitioner, above named, in the event
Patna High Court CR. MISC. No.10273 of 2025(2) dt.28-03-2025 2/2 of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge, II-cum-Special Judge, Excise Act, Madhubani/ concerned Court below, in connection with Arer P.S. Case No.44 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

At the time of accepting the bail bonds of the petitioner, the Court below shall verify the fact whether the petitioner has clean antecedent or not. The bail bonds of the petitioners shall only be accepted if it is found that the petitioner has clean antecedent.
