Case no. 05/2013 registered under section 392 of the IPC and accordingly, both the above stated petitions are being disposed of by this common order.

Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State.

No.50498 of 2014 (4) dt.31-03-2015 Petitioners are not named in the first information report nor anything was recovered from their conscious possession and it appears that names of these petitioners came in this case in the confessional statement and in the statement of one witness, namely, Umesh Singh who stated in his statement recorded under section 164 Cr.P.C. that petitioner and other accused were talking in respect of alleged loot. Moreover, co-accused person Vivek Singh has already been granted privilege of bail by a coordinate bench of this court. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above stated petitioners be released on bail on furnishing bail bonds of Rs 10,000/-each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in Chandi P.S.
