JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Baghaila P.S. Case No. 69 of 2018, registered for the offences punishable under Sections 304B and 120B of the Indian Penal Code.

Allegation as per FIR against the petitioner and others is of committing dowry death and petitioner happens to be maternal uncle of the husband of the deceased. Submission of learned counsel for the petitioner is that one Bikarma Singh has been made accused in the FIR and petitioner is not Bikarma Singh and he is a resident of village Meerganj and even if the allegation against the petitioner is believed, only allegation against him is that he abetted the other accused persons for demanding dowry.

Heard learned APP and learned counsel for the

Patna High Court CR. MISC. No.8413 of 2019(3) dt.23-04-2019 2/2 informant, who opposed the prayer for anticipatory bail on the basis of material that he abetted the other accused persons for demanding dowry.

Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Sub-Judge-IX-cumAdditional Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Baghaila P.S.Case No. 69 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
