JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 17-07-2023 Heard Mr. Abhinav Srivastava, learned counsel appearing on behalf of the petitioner; Mr. Mujtabaul Haque, learned GP-12 along with Mr. K. K. Sinha, learned counsel for the State Health Society.

2. Mr. Abhinav Srivastava, learned counsel appearing on behalf of the petitioner submits that he will advise the petitioner to file a fresh representation considering the fact that final decision has not been taken with respect to the departmental proceeding initiated against the petitioner.

3. Considering the aforesaid fact and information

Patna High Court CWJC No.2957 of 2023 dt.17-07-2023 2/2 provided by the learned counsel appearing on behalf of the petitioner, the Additional Chief Secretary, Health Department, Government of Bihar is directed to dispose of the departmental proceeding pending against the petitioner, if any. In case, final order has not been passed till date, he must pass within three months. In the meantime, he must ensure payment of the retiral dues payable to the petitioner. After passing of final order he must ensure to make other remaining dues as per his entitlement in accordance with law within the aforesaid period.

4. The writ application, accordingly, stands disposed of.
