====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-05-2023 Heard learned counsels for the petitioners and the State.

Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 324, 354(B), 379, 427, 504, 506/34 of the Indian Penal Code. Petitioner No. 1 is alleged to have assaulted with iron rod on the head of one Zakir Safi whereas, petitioner No. 2 attacked the informant, disrobed her and snatched Rs. 50,000/- cash.

Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the present case. It is next submitted that due to land dispute, an

Patna High Court CR. MISC. No.10841 of 2023(2) dt.15-05-2023 2/2 altercation took place between the parties. Injuries sustained by the injured are simple in nature. Case and counter case. Petitioners have got clean antecedent.

Considering the aforesaid facts and circumstances, this anticipatory bail is allowed and it is ordered that the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Jhanjharpur, Madhubani in connection with Phulparas P. S. Case No. 308 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
