1. Heard learned counsel for the petitioners and the learned A.P.P. for the State.
2. The petitioners apprehend arrest in connection with Rauta P.S. Case No. 124 of 2023 registered under Sections 376, 498(A), 420, 34 of the Indian Penal Code and Section 4 of the Muslim Mahila Marriage Protection Act.
3. Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case due to dirty village politics. Petitioner no.1 is father-in-law and Mausa of the informant and petitioner no. 2 is Dewar and Mausera brother of the informant. There is specific allegation against co-accused Md. Hammad
Patna High Court CR. MISC. No.12742 of 2024(2) dt.18-03-2024 2/2 Masud. Further he submits that petitioners have no criminal antecedent.
4. Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bonds to the satisfaction of the Chief Judicial Magistrate, Purnea in connection with Rauta P.S. Case No. 124 of 2023 subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) shailendra/- U T
