Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-03-2022 Heard Mr. Nil Kamal, learned Advocate for the petitioner and the learned APP.

The petitioner seeks bail in anticipation of his arrest in connection with Rajpur P.S. Case No. 284 of 2020 dated 20.11.2020 instituted for the offences under Sections 341, 323, 504, 307 and 34 of the Indian Penal Code.

Though the petitioner is alleged to have hurled tangi blow on the head of the informant but the injury suffered by him is stated to be simple in nature and that also, caused by hard and blunt substance.

The learned counsel for the petitioner has submitted that tangi is a sharp-cutting weapon. He therefore urges that the injury report is not in consonance with the ocular testimony in the FIR.

Regard being had to the general nature of accusation and the injuries suffered by the informant being simple in nature, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Rajpur P.S. Case No. 284 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
