The petitioner seeks bail in a case registered under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that there is allegation of firing by all the accused persons but the informant received only two injuries and there is no specific statement in the first information report as to upon whose gun shot fire the informant received injury. That apart, it is also stated that there is some confusion with regard to the identity of the petitioner as in the F.I.R. he is stated to be Munna Mian son of Aslamuddin Mian however, in his pan card, a copy of which has been appended as Annexure 1, he is shown as Mir Abadul Alam, son of Aslam
Patna High Court Cr.Misc. No.50587 of 2014 (3) dt.04-03-2015 2 / 2 Mian. Learned counsel further contends that a joint petition on behalf of the informant and the petitioner has also been filed stating that they do not want to proceed in the concerned criminal litigation. Petitioner is stated to be in custody since 16.09.2014. It is also stated that the petitioner is having no criminal antecedent. Having regard to the facts and the circumstances of the case, the petitioner, Mir Abdul @ Munna Mian @ Mir Abdul Alam is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in connection with Barahiya P.S. Case No.160/2014 (G.R. No.1403/14).
