2. The petitioner is in custody since 12.08.2014 in connection with Sakra P.S.Case No. 367 of 2014 for the offences alleged under Sections 394, 395, 397 and 412 of the Indian Penal Code.

3. It is submitted that the petitioner has been falsely implicated on mere suspicion as there is nothing to connect him with the alleged occurrence as there is also nothing to show that the articles were found in the kitchen of the Government Middle School, Supaul were the same which was being carried in the Truck by the informant. Petitioner has not been identified as no T.I. Parade was conducted. Petitioner claims clean antecedent and

Patna High Court Cr.Misc. No.48921 of 2014 (2) dt.20-02-2015 has been languishing in jail for more than six months.

4. Having regard to the entirety of the facts and circumstances of the case, let the petitioner Mantu Kumar @ Mintu Kumar be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur, in Sakra P.S. Case No. 367 of 2014 with condition that the petitioner shall remain physically present in Court on each and every date during trial and in the event of failure on two consecutive dates, his bail bond shall be liable to be cancelled by the learned Court concerned.
