1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Barari P.S. Case no. 286 of 2020 registered under sections 307, 386, 427 and 34 of the Indian Penal Code and section 27 of the Arms Act.

3. As per the prosecution case, the ten named accused persons including the petitioner herein resorted to indiscriminate firing on the informant who somehow saved himself.

4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. Allegations are false and concocted. No person was injured in the entire occurrence. The petitioner is in custody

Patna High Court CR. MISC. No.13740 of 2024(2) dt.12-03-2024 2/2 since 18.9.2023 and chargesheet has been submitted in the case.

5. Heard learned A.P.P. for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R. wherein general allegation of firing is levelled against ten named accused persons together with no person having been injured in the entire occurrence and the petitioner having remained in custody for more than 5 months since 18.9.2023 and and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Barari P.S. Case no. 286 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Katihar.
