JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04/ 14.10.2015 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Trial court has reported that in compliance of direction of this court, Sr. S.P. Gaya procured the attendance of some of prosecution witnesses and produced the prosecution witnesses till 6.5.2015 but after that did not produce remaining witnesses. Petitioner is in jail custody for more than four years on the accusation of having caught with 80 kgs ganja. Therefore, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Amas P.S. Case no. 134/2011 corresponding to NDPS case no. 20/2011 pending in the court of Addl. Sessions Judge I- cum- Special Judge, Gaya/concerned court is, again, rejected. However, the trial court is directed to conclude the trial of the petitioner within three months from the date of receipt/production of a copy of this order even by taking trial of the petitioner on day to

Let a copy of this order be sent to Senior Superintendent of Police, Gaya with direction to him to ensure presence of remaining prosecution witnesses of the aforesaid case before the concerned court within a period of one month from the date of receipt/production of a copy of this order.
