JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-02-2020 Petitioner seeks regular bail in connection with Ramgarhwa P.S. Case No. 300 of 2018 registered for the offence punishable under Section 392 of the Indian Penal Code. As per prosecution case, petitioner and other accused persons on the point of knife snatched Rs.51,530/- from the informant. Petitioner is not named in the F.I.R., later on his name was transpired only on the basis of confessional statement of co-accused and his previous criminal history. Submission of the learned counsel for the petitioner is that without any enquiry police just randomly made him accused of this case and he has not put up on T.I.P.. Petitioner is in custody since 03.08.2019. Charge-sheet has already been submitted and there is no chance of tempering with the evidence.

Heard learned A.P.P. who has opposed the prayer for bail on the ground that petitioner is accused in seven other

Patna High Court CR. MISC. No.7543 of 2020(2) dt.18-02-2020 2/2 similar type of cases.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned S.D.J.M., Raxaul at Motihari, in connection with Ramgarhwa P.S. Case No. 300 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned and further condition is that after release, he has to appear before the police of his local area for a period of nine months or till the conclusion of the trial, whichever is earlier, so that the police may watch his conduct, otherwise his bail bond shall be cancelled.

Let a copy of this order be communicated to the S.P. East Champaran at Motihari, for needful.
