The petitioners are accused in connection with Kateiya P.S. Case No. 24 of 2013 registered under sections 304(B)/34 of the I.P.C. pending in the Court of C.J.M., Gopalganj. Earlier prayer of the petitioner for bail was rejected vide Cr. Misc. No. 37771 of 2013 on 21.02.2014 by this Court on merit taking into consideration the nature of allegation. The report regarding the present stage of trial has been received through Letter No. 120 dated 17.04.2015 discloses that out of eleven prosecution witnesses named in the chargesheet, only three witnesses have been examined and the trial is likely to be concluded within nine months.

Patna High Court Cr.Misc. No.43 of 2015 (3) dt.23-09-2015 2/2 Having considered the facts and circumstances of the case, I find no fresh ground to re-consider the prayer of the petitioner for bail. Accordingly, the application is rejected. However, Trial Court is directed to conclude the trial within nine months by taking all effective steps. If the trial is not concluded within the aforesaid period, the petitioners would be at liberty to renew his prayer for bail.
