The petitioner seeks bail in anticipation of his arrest in connection with Town (Siwan) P.S. Case No. 123/2017 dated 04.03.2017 instituted for the offences under Sections 406, 420 and 34 of the Indian Penal Code.
The allegation against the petitioner is of having deposited Rs. 8500/- only in the account of Alen Career Institute Kota, Rajasthan whereas the informant had given him Rs. 85,450/- to be deposited in the aforesaid account as Coaching Fee for his younger brother. Patna High Court Cr.Misc. No.8818 of 2019(2) dt.14-02-2019 2/2 submitted that the informant had made a complaint about this act of the petitioner before his father who in his wisdom had paid the amount so kept behind by the petitioner, to the informant. Learned counsel for the petitioner has also drawn the attention of this court to the acceptance of the aforesaid amount by the informant from the father of petitioner.
Considering the aforesaid facts, petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Town (Siwan) P.S. Case No. 123/2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) vinita/- U T
