The petitioner apprehends his arrest in connection with Khizarsarai P.S. Case No. 294 of 2018 registered under Sections 379, 420, 467, 468, 472, 474 and 34 of the Indian Penal Code and Section 66(C) and 66(D) of the Information Technology Act, 2000.

Learned counsel appearing on behalf of the petitioner submits that similarly situated co-accused persons have already

Patna High Court CR. MISC. No.19015 of 2021(2) dt.27-01-2022 2/3 been allowed bail by a Co-ordinate Bench of this Court vide Cr. Misc. No. 75042 of 2019 on 02.12.2019 and Cr. Misc. No. 26004 of 2020 on 18.12.2020.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IV, Gaya in connection with Khizarsarai P.S. Case No. 294 of 2018, subject to the condition as laid down under Section 438(2) of the Cr. P.C. i.e.

(i) a condition that the person shall make himself available for interrogation by a police officer as and when required;

(ii) a condition that the person shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;

(iii) a condition that the person shall not leave India without the previous permission of the Court.

No.19015 of 2021(2) dt.27-01-2022 3/3 And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner.
