The writ application has been filed seeking payment of Leave Encashment due to the father of the petitioner, who retired as a Teacher, working in an aided Minority Middle School, on 31.08.2010.
Learned counsel for the petitioner submits that the issue has already been decided by this Court in the case of Charley Lazarus vs. The State of Bihar & Ors. in C.W.J.C. No. 23 of 2015 by order dated 03.08.2015.
On 17.09.2016, the case was adjourned to enable
Patna High Court CWJC No.13856 of 2016 dt.19-09-2016 2/2 learned counsel for the State to go through the order passed in the case of Charley Lazarus (supra).
Today, submission by learned counsel for the State is that the said order covers the present case.
In view of the aforesaid, for the reasons recorded in the order dated 03.08.2015 passed in C.W.J.C. No. 23 of 2015, the application is allowed and the writ petition stands disposed off in terms of the said order.
