====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner and the State. Petitioner seeks bail in a case registered for offences punishable under Sections 395/397 of the Indian Penal Code. It is submitted on behalf of the petitioner that the First Information Report has been lodged against the unknown persons, however, his name has been taken by one of the co-accused, namely, Ajay Kumar Yadav, in his confessional statement. It has been further submitted that neither anything has been recovered from the possession of the petitioner nor has he been put on Test Identification Parade. It is also urged that the petitioner has remained in custody since 02.08.2014.

Having regards to the facts and circumstances of the case, the petitioner, namely, Mister Yadav, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees

Patna High Court Cr.Misc. No.48571 of 2014 (2) dt.03-03-2015 Ten Thousand) with two sureties of the like amount each to the satisfaction of the Smt. Sulekha Jha, Judicial Magistrate, Ist Class, Munger in Dharhara P.S. Case No. 82 of 2014 with a further condition that one of the bailors of the petitioner must be his father. Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.

Further, the petitioner shall remain present on each and every date during the course of the trial in the court below. If the petitioner fails to remain present on two consecutive dates during the course of the trial without any reasonable cause being shown, the court concerned would be at liberty to take steps for cancellation of his bail bonds.

That apart, in view of the antecedents of the petitioner, he would be required to appear before the Superintendent of Police, Munger within fifteen days of his release with a copy of this order and every two weeks thereafter for the next six months. The conduct of the petitioner will be kept under watch in the aforesaid period by the Superintendent of Police concerned and if it is found wanting in any respect, a report shall be made to the court concerned by him to initiate a proceeding for cancellation of bail

Patna High Court Cr.Misc. No.48571 of 2014 (2) dt.03-03-2015 for reasons of misuse of bail. After reporting to the Superintendent of Police, a certificate will be filed by the petitioner before the court concerned which should be granted by the Superintendent of Police upon his appearance.
