JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. It would appear from perusal of the first information report, that on 04.09.2014 at about 8.P.M an altercation took place between the petitioner and deceased and allegedly on the same night at about 11p.m petitioner went to the house of the deceased and took him and thereafter, deceased left his house in the company of the petitioner but later on his dead body was found in the morning. In the post mortem examination some injuries were found on the upper part of the body of the deceased but doctor kept opinion reserved in respect of cause of death of the deceased. Patna High Court Cr.Misc. No.50998 of 2014 (4) dt.02-04-2015 2/2 disclosed this fact that in the night of alleged occurrence, deceased was taken away by the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with Darbhanga Sadar ( Bhalpatti O.P) P.S.Case No. 341 of 2014.
