JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 25-02-2019 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Chakia P.S. Case No. 01/2019, for the offence under Section 30(a) of the Bihar Prohibition & Excise Act.

Learned counsel for the petitioner submits that petitioner is 65 years old. He has no criminal antecedent and in the instant case 61.56 litres of liquour was seized. He further submits that there is no recovery from the conscious possession of the petitioner or from his house.

The petitioner is in custody since 01.01.2019. Considering the fact that the petitioner has no criminal antecedent, the petitioner named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000 (Ten

Patna High Court Cr.Misc. No.11186 of 2019(2) dt.25-02-2019 2/2 thousand) with two sureties of the like amount each to the satisfaction of 7th Additional Sessions Judge-cum-Special Judge Excise, East Champaran, Motihari in connection with Chakia P.S. Case No. 01/2019.
