JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-02-2020 Heard learned counsel for the petitioner and the State. The petitioner is apprehending arrest in connection with Complaint Case No. 301 of 2018 for the offence under Section 498A of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is ready to keep his wife with full honour and dignity.

Learned counsel for the informant submits that the informant has no difficulty in staying with the petitioner provided proper care and honour is extended to the informant. The marriage took place on 19.04.2016.

No.7311 of 2020(2) dt.29-02-2020 2/2 Considering the fact that there is possibility of restoration of normal conjugal life, the Court is inclined to grant bail to the petitioner, in the event of arrest or surrender within four weeks from today, on furnishing bail bond of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial MagistrateIV, Kaimur (Bhabua) in connection with Complaint Case No. 301 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. After release the petitioner shall be under obligation to keep his wife with full care, honour and dignity and in the event of any complaint as to neglect, misbehaviour or torture by the informant of this case, the Court below shall be at liberty to cancel the bail bond of the petitioner.
