2. The present application has been preferred for the following relief(s):
(i) for issuance of writ in the nature of "Mandamus" upon the concerned respondents to release the seized vehicle (Tractor) of the petitioner No 1 bearing Registration No. BR01GK6735 and Petitioner no. 2 bearing Registration No. BR-01GL7983 which has been illegally seized on 9.12.2025 in Digha P.S. Case no. 926/2025, without any notice or opportunity

ii. For issuance of an appropriate writ or any other order or direction commanding the respondent authorities to release the vehicle (Tractor) of the petitioner no. 1 bearing Registration BR-01GK6735 and Petitioner no. 2 bearing Registration No. BR-01GL7983 which has been illegally seized on 9.12.2025 in Digha P.S. Case no. 926/2025 iii. For direction to the respondent authorities to pay compensation to the petitioner for illegal confinement of his commercial vehicle.
iv. For issuance of such other order or direction as the petitioner may be found entitled to in the facts and circumstances of the instant case.
3. The petitioners own the tractors having Registration No. BR-10GK6735 and BR-01GL-7983 which now stands seized following Digha Police Station Case No. 926 of 2025 on 09.12.2025 after respondents found that it is being used for the transportation of the sand without any challan.
4. At the outset, learned counsel for the petitioners submit that they shall be fighting out the legal battle but the vehicle is deteriorating under the sky for the last six months and they are also facing the economic loss.
5. In that background, they are ready to pay the amount but the same be made in installments so that they are able to pay the

6. Learned counsel for the Mines Department submits that if the two petitioners individually approach the Mineral Development Officer, Patna along with their request and the order of the Court, they shall be taking note of the fact and if the fine amount is paid, the vehicle shall be released.
7. In that background, the writ petition is disposed of allowing the two petitioners to approach the Mineral Development Officer, Patna along with their respective petitions who shall be providing the fine amount which has to be paid in three equal installments in the following manner:
(i) the first installment at the time of release of the truck;
(ii) the second and third installment by 10th of September 2026 and 10th of November, 2026.
(iii) Further, they shall be duty-bound to present the vehicle as and when required and under no circumstance, it shall be alienated.
8. The writ petition is disposed of with aforesaid observation.
