Petitioner is in jail custody since 08.08.2014 in a case registered for the offence punishable under Section 47 A of the Excise Act.

Although, petitioner is named in the first information report and he carries criminal antecedent of two cases of similar nature but admittedly, petitioner was not caught at the spot nor prosecution could succeed to establish that the seized vehicle belongs to the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri
