Petitioner is seeking anticipatory bail in connection with Sakra P.S. Case No. 233 of 2018 registered for the offences punishable under Sections 147, 148, 149, 341, 379, 406, 452 and 506 of the Indian Penal Code.

It appears from perusal of the records that this police case arises out of a complaint petition filed by one Bus owner giving rise to Complaint Case No.547 of 2018 in the Court of learned Chief Judicial Magistrate, Muzaffarpur. The complainant alleged that the Bus was standing at his place and the Watchman deputed by him was taking care of the Buses but on the alleged date of occurrence the accused-petitioner came on the Bolero vehicle lashed with arms and took away the vehicle forcibly. It was informed that the Bus was taken away for some reserved engagement. The complaint petition also discloses that the Bus of

Patna High Court Cr.Misc. No.8226 of 2019(2) dt.15-02-2019 2/2 the complainant was running under the firm namely, R.M.D firm of which the accused is the owner but the complainant had withdrawn his bus being aggrieved by the unjustified act and omissions of the accused.

Although, learned APP for the State has opposed the prayer for anticipatory bail but in the nature of allegations, the facts and circumstances which are appearing from the complaint petition and that the petitioner has no criminal antecedent as stated in Paragraph 3, in case of arrest or surrender of the petitioner within a period of four weeks from today, the abovenamed petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VI, Muzaffarpur in connection with Sakra P.S. Case No. 233 of 2018, subject to the condition that petitioner shall join the investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation. This will be in addition to condition prescribed under Section 438(2) of the Cr.P.C.
